The media won't say this, and neither apparently will the police, so I will.

Because they buried her in this shirt and called it good.

That is as silly as the "Don't dry your cat in the microwave" label. No matter how idiotproof you make anything, there will always be dumber idiots.

Funny as it may seem, how many people put their cats in a microwave.

People jumping onto train tracks for stupid reasons does happen on the other hand. So I do think Tiberius has a point in bringing this up.

The outcome is by no means overwhelmingly probable, and the participant in question did not undertake the action in question in an attempt to cause the relatively improbable outcome to eventuate. This is the definition of "accident". Accident has nothing to do with rules, or any evaluation of risk and reward that would meet with your approval.

Name me another type of "accident"

http://www.thefreedictionary.com/accident

"An unexpected and undesirable event, especially one resulting in damage or harm"

Explain how when you jump onto a train track, getting hit by a train is somehow, 'unexpected'.

Could've been worse.

She could've sent the kid to fetch it.

You can fix ignorance, you can't fix stupid.

Because suddenly jumping up onto a live train track to get a phone (the decision) is unexpected?

Seriously, do I have to spell it out for you?

The fact that this event is unpredictable makes it qualify for 'unexpected'.

How the fuck is it unpredictable? Are you mad? If I was standing at a train station and saw someone jump onto the train track, who then proceeded to be flattened by a train, I wouldn't be sitting there afterwards thinking "Duh, well I didn't see that one coming".

NOBODY EXPECTS THE JUMPER!

Not as effective as the Spanish Inquisition.

You're not expecting the woman to jump.

Look, I'm not saying she wasn't stupid, but if she's like me then pretty much her whole life is on that phone. I would have called a security guard or someone to help me get it off the track, but she might have just panicked. That's why I'm saying there should be signs stating where you can get help. That's all.

What is the probability of being hit by a train for each random act of "jumpting onto the track"? 100%? Are you insane? 50/50? Which track carries a train 50% of the time? You have to admit the chance of being hit by a train during a short sojourn on a track required to retrieve a phone is actually rather low, as for as fraction out of unity goes.

So I don't think she expected to be hit by a train, the odds were not that she would be hit by a train, the odds of her being hit be a train might be higher than you are comfortable with, but it most certainly is not the expected outcome as far as statistics goes.

For fucks sake I hate being retarded. Yes Moros I get you, but I don't think the decision should be what ascertains to calling it an accident.

The thing is a half-inch wide cell phone is likely to have the train pass right over it with no damage. Once the train goes by THEN you pick it up.

I actually couldn't give a flying fuck. Jumping onto a train track and getting whacked by a train is not unexpected don't care how you want to argue. Same as jumping out onto a road and getting hit by a car isn't 'unexpected'.
