They've likely got a good case. The appeals court is giving the government the side-eye in the remarkably similar Alina Habba case.

SCOTUS won't care. They've already demonstrated their pretzel logic regarding precedent. Does anyone think the will abide their own precedent despite any contradictions? I don't. I predict a Trumpian "I was just joking" moment, or a "no, no, we were misunderstood."
This court doesn't give a shit about consistency. The majority, after all, claims to want to read the Constitution from the viewpoint of the Framers, yet this same majority asserts that our Constitution permits autocracy -- when that was the last thing the Framers wanted. If they don't care about such a grand inconsistency as that, does anyone think a decision they made a few months ago will cause problems? I don't.

The physician struggled with precisely the same calculation at a White House press conference on October 16, held to promote a new deal on fertility drugs, when he said at one stage in his address: “You’ll notice, President Trump, these are discounted from $242 to $10.
“I don’t know what the math is on that. We can’t even calculate it. It’s too high to calculate.”
A reduction from $242 to $10 is 95.87 percent.
