Equality itself doesn't make something fair... but in and of itself equality is better than unwarranted discrimination, right?
The best option is of course truly warranted discrimination, when each person is treated as an individual who has different needs, but completely fairly and justly. But that is very difficult to do properly, hence why when it comes down to it, between a choice of the risk of unwarranted discrimination or equality, equality wins over, I reckon.

Why would the discrimination be unwarranted?
I think it is unjust to bar people from wearing (or not wearing) certain types of clothing SIMPLY because some people don't like how it looks. It is just as ridiculous to arrest you for wearing a black dress as it is to arrest you for wearing nothing. Arresting a person because they are not wearing anything is worse imo... because underneath all of those adornments: we are all naked... our nakedness is default... why should the default system be illegal whereas that which is built atop the default legal? That just doesn't make any sense.
