Tracking and personal data collecting is in their TOS and by installing Windows 10 you agree with them, so Microsoft can do whatever they want and no one can do anything about it.
I would install Windows 10 only after hackers have identified the executables for the keylogger and for the mandatory updates which you'll receive whether you like it or not.
That problem with tracking and key logging is vastly discussed in Bulgarian forums and tbh I dread the things I read about W10 - written by people who already have the test versions. What MS are planning to do will make "Big Brother" look like a first grader's homework.
