Even in the pre-Civil War era, the dilemma was clear, especially as the 1850s increased the rights of slaveholders with the Fugitive Slave Act, the Kansas-Missouri Compromise, and the Dred Scott decision; but it didn't bother the South. If it fucked up the lives of black people, who cared if they technically infringed on the rights of states to do what they wanted, just as long as the Southern slaveholders could keep on doing the same thing they wanted to do?
