Congress can vacate it. And if they don't, it will probably be tied up in court for long enough that the clock will run out in 2020. This could be sort of a good thing, since it might occupy Trump's attention sufficiently to keep him from trying other things. He'll maybe spend the next 20 months obsessing with his court battle and not doing much else. Afterwards, he'll have to find something else to occupy his time, such as defending himself against endless civil and criminal court proceedings.
Can and will are two different things. Too much of the GOP has their heads up his butt.
And the other thing you miss is that this fake emergency is not a real emergency as prior presidents have used. This is clear overreach, and sets a dangerous precedence for a future president to do even worse. One should not simply take this one event today as a single event. When you listen to his rhetoric since he started his run, and while in office, all of it is intended to undermine checks on his power. He is literally talking like a Mafia boss. That is the way you talk when someone tries to question you when you know you are doing something wrong.
Missing something and not stating the obvious isn't the same thing. It's a fake emergency? Wow, not much gets past you.
