40% is the pertinent figure because it represents arrest situations/perilous encounters with law enforcement, not just genpop regardless of police interaction. SURELY you can see that.
I'm kinda glad you brought up the 12% figure though: yes, black people do commit over THREE TIMES more crime, per capita, it is fair to say, than whites.
How come it's "white culture" in the dock over this BLM nonsense when, really, it should be targeting systemic criminality in the US black culture of America which results in them committing astronomically more crime (you know: murder, crystal meth dealing, heroin dealing, GBH, rape, theft - crime bad to the extreme so gotta go to prison) which is a TRUE cancer to society, instead of a fictional BLM handwringing emotional violin playing retard fest.
