the gender in many traditional societies seem to be hardware plus software that are expected to be loaded to suit the hardware. firmware is expected to conform and keep quiet. firmware that fail to do so is considered buggy. loading the wrong software would e considered a serious user error.
I think components that may constitute gender are conceptually not ill defined. what is meaningfully ill defined is the exact collection of components should be included in such definition of gender as appropriate to form basis of law.
