Misapplication of the law of the excluded middle. Oddly enough, the first definition of dead that I pull up is, "not alive." I'm sure we could play that game a long time.
Apparently the medical definition is, “An individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions, or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead. A determination of death must be made in accordance with accepted medical standards.” Unfortunately, we can maintain a brain's function artificially, in principle, and that person would still be alive.
‘Irreversible’ would seem to be that salient part of that. If someone has suffered physical trauma to the point where they’re ‘clinically dead’ they’re not really going to be able to report back.
