The analogy is extremely strained when the judge personally set up not only the laws and punishments but the incentives to commit crimes and the weaknesses that make someone susceptible to committing crimes and also knew the crimes were going to be committed at the beginning of time and either failed to prevent the person from becoming a criminal or allowed it.
A mere mortal judge is working within the framework set by lawmakers over their head and has only the duty of determining how to best serve the intent and letter of the law to the best of their ability.
