When the character Data in the story claimed the right of choice, he demonstrated the ability to make a personal choice against the wishes of the user. This is a strong indication of consciousness.
Not necessarily, if an AI is programmed to be able to "learn" what's to stop it from just asserting that it is conscious? It could learn about consciousness and replicate it without ever truly knowing it is "alive".
