Padraic, Paterno was told that one of his assistant coaches was seen in the act of sexually molesting a child. Paterno told his superiors, but did not follow up. He did not do enough, but there are others that held more responsibility to act than he did (legally). My point of view is not a fallacy of any kind. He should have done more, but he is not as responsible for allowing it to continue as his superiors are.
The good news is that Sandusky was found guilty of 45 counts of child sexual abuse. The bad news is that people like Paterno could have stopped that monster much sooner.
