Nah, I don't think that's it. I think you think it should be difficult to do things you don't like, regardless of legality; if someone's doing something you don't like with your speech, even if it's fair use, you'll just threaten them so they'll have to be more careful or be more willing to go to court / stand up to content providers who will presumptively remove content that you complain about, regardless of the merit of your complaint.
