Of course, we're working under the assumption that there is more than sufficient evidence that proves beyond any doubt that these people did commit that crime...
Imagine there is room for doubt... Imagine you, as a judge, sentence these people for death.... and a few days, months, or years later new evidence comes up and...ooops.... you got the wrong blokes... what then?
I prefer to err on the side of caution.
Imagine I have a shitty life, I go out, grad some girl, fuck her brains out and kill her in the process.... go to jail... get bed&board for free in a "controlled" environment for the rest of my life.... that's an upgrade, with the plus of having boned a girl, when the most likely was to remain boneless for the rest of my life.
A punishment is supposed to have two goals:
1) provide a very negative experience which should accompany the original act, thus discouraging that person from doing it again.
2) be enough deterrent to prevent, at least, the large majority of people from ever trying it.
And then the "justice system" doesn't get that name for nothing.
If you do something wrong, you must pay for it... and paying for it means giving something back to society... what could someone capable of such an act give back to society?
