Well, drinking is one thing, doing drugs is another. One is legal, the other is illegal. I personally would not take chances with hiring someone that was a habitual drug user.
If anyone is going to work for me, he or she must be clean. Some companies are not even okay with hiring smokers, let alone those who do drugs.

What does legality have to do with it?
