I was a little curious so I visited the answering genesis website. They have a little article about Kentucky's decision.

Sounds like they are gearing up to sue the state. They might have a case on their hands.
Here is the Kentucky law they cite:

I imagine the issue they will argue is that the state wrongfully discriminated against them by refusing to allow them to engage in this sales tax rebate program because they are a religious organization exercising their rights as a religious organization to prefer to hire people of their religion.
