This wasn't some special kick back to Hamm. The is a pre-established rebate program to provide an incentive for people to build tourist attractions. If Disney decided to build Super Disney World in Kentucty....they would apply for this program and probably get approved for it just like the Ark clowns did.
This isn't some subsidy....it is a state incentive to bring money and jobs to the state. And now it seems, the state might be discriminating against religious corporations by not allowing them to participate in this program.
Me thinks this is going to become a fascinating case.
