The point still stands, if you require different, more stringent circumstances for one over the other based on nothing more than homogeneity of gender, then it is still discrimination.
In the state in question, making a common law marriage recognized requires an inquiry presided by a judge. Meaning this bill would still give the judge the authority to deny even common law marriage based on the fact that a couple is same-sex.
