Probably because the damage is less. Why is a person who punches someone in the face not treated legally the same as a murder? Both actions are forced upon the victim and both actions are deemed wrong by most people.

There's a huge difference between rape fantasy and actual rape. The main difference being that one is consensual and the other is not.

It came from some people saying rape isn't always wrong if it's animals and not humans that are doing the raping of each other and some people disagreeing and some people saying that isn't actually rape at all.
