Let's assume for a moment that you have iron-clad proof of abuse by a police officer. Let's say you've got video footage and everything. So you file a complaint. First thing that happens is the case goes to the DA's office. The DA thinks, "Hm, let's see, I could piss off the people I depend on to do my job by investigating this complaint or I could curry favor with said people by throwing you under the bus and round filing your complaint. What should I do? Decisions, decisions. WHO did you say you were again?"
But let's just assume you've got a total sap for DA who's willing to risk his/her entire career for some nobody like your sorry ass just because it's the right thing to do.
Immediately, the police union circles the wagons around this bad apple and marches into the mayor's office to lay out the situation. Beyond the fact that the police union usually swings a heavy political bat in a local area, they can threaten the mayor with an unofficial strike. Oh sure, it's not legal for the police to go on strike but they can "feel demoralized" and "be afraid to do their jobs because we might get in trouble". No, we're not on strike or anything *wink wink*.
Total political shit storm ensues. So what's the mayor going to do? Is he going to go to bat for some nobody? Who did you say you were again? Or is he going to throw you under the bus to re-establish peace in the community? Maybe they will be some sort of Kabuki theater investigation to mollify the public if there's enough outrage. It's unlikely you'll get an indictment, never mind a trial, never mind a conviction.
Your only hope for prosecution of a bad cop is if there's enough of a stink that the feds enter the scene. We've seen that happen a lot. My guess is they have limited resources and don't like to ruffle local feathers in case they need a favor on down the road.
I don't know what the solution is. Who protects us from our protectors?
What exactly is the dA's job supposed to be, then? If complaints go to them first, then I would assume it's their job to resolve it, and put away the criminal with a badge. so how can they get in trouble for doing their job?
