Every year, Democrats' sole argument of "We are not Republicans" wears thinner and thinner.
As much as I know about it, that’s not the way it works - ANY law can be challenged before the Court as unConstitutional. How such a suit is decided depends very much on the make-up of the Court at any given time.
Laws have been struck down as being unConstitutional before, pro-choice laws would be no different. The only possible way to take the SC completely out of the equation would be via a Constitutional amendment which specifically and explicitly guaranteed bodily autonomy, and - to the best of my knowledge - Democrats have never controlled enough state legislatures to make that happen.
