They had a few super-majorities over the last 50 years where they could've codified Roe v. Wade and not had to worry about SCOTUS. But they didn't, they just liked running on the issue then doing fuck-all about it. If they don't do anything about it before the midterms (where they will surely lose their majority in both chambers) I think the younger generations will be hard-pressed to vote D ever again.
Codifying Roe v. Wade would have guaranteed a Republican majority in the next cycle to revoke it. Striking Roe v. Wade down may give Democrats a majority in the midterms and they'll have a mandate to codify it then as well as a chance to hold on to power long enough to make it stick.
It would not have guaranteed Republican majority. How do you figure that? Nearly 70 percent of Americans believe in Roe, and the vast majority of Democrats. Democrats have used abortion as a rallying cry for folks to vote for nearly 50 years! How is letting abortion rights be gutted before the midterms in Democrats' favor? If anything it will be the opposite.
