It seems to me that a rapist has at least one distinguishing feature that can be psychologically tested, a lack of empathy. If you simply classify a lack of empathy a dangerous sociopathic mental illness that requires quarantine, then the rapist can be legally confined until he is not a risk to the public.

In many states in the US, you can kill someone and be out in 7-10 years. I hardly think rape is more serious than actually killing someone.

Yep that article nails the problem on the head. What generally can happen in Australia is an ex-rapist gets chased out of a community and ultimately lives among far more vulnerable people where their behaviour is more likely to be reinforced.

I know this is just talking. For whatever reason people feel the need to say this kind of thing. It's disgusting though. Rapists are people too. Perhaps some or maybe even most are horrible people. Maybe some would even call them monsters. They're still people, though. I don't understand this idea that someone could do something wrong and it would justify you doing something wrong to them. I don't understand the notion that it is noble, just, or morally correct to harm people who you consider bad people. If you were to castrate a rapist against his will, that would make you just as horrible a monster in my books. How you could even think that would ever be acceptable to do to anyone for any reason is completely beyond me.

I've thought a lot about the different issues in criminal justice, and have sort of settled on the opinion that a good starting point is to 1) determine the minimum punishment that would be needed to protect people from serious ham, 2) determine the minimum punishment that would be needed for society at large to feel like "justice has been served", and then 3) impose whichever of those two is greater. It's not always perfect but I think it gets close. #1 is determined by things like recidivism rates, risk factors, personal history and the like, and #2 is sort of based on history and is set by the legislature in the form of sentencing guidelines and such.

Under that theory, I agree that the individual circumstances of a particular rape, or any crime, are very important. In the US, a certain subcategory of rapists, those classified as "sexually violent predators," are, after their jail term, involuntarily committed to an institution where they're evaluated every year or so to determine if they'd be a threat. Many never get out. Still, they have the chance.
