Not surprised by this decision.

I'm surprised they agreed to hear the upcoming immunity case at all. It would have been easy for them to non-cert, side with the appellate court, and affirm that immunity is always qualified and never absolute. No one is above the law. But they didn't do that and instead we will get to see where the justices lean on the matter of Kingship.

Trump's own lawyers argued that POTUS could be prosecuted if impeached and convicted by the senate. Therefore POTUS immunity can't be absolute because dumbass's law team just demonstrated a scenario where POTUS's immunity conditional.

And if it's decided that POTUS always has immunity unconditionally, then it follows that Biden enjoys that same immunity and could have his henchmen go after Trump physically.

Denying cert would certainly be the most expeditious path available, but that would allow at least one of the criminal trials to conclude before the general election, and we just can't have that.

Biden could still do it WITH impeachment, he just needs to make sure his henchmen send a message to Congress of what will happen to them if they pass a vote to impeach. But he won't do either.
