Evidently, Savita Halappanavar was not protected by the Eighth Amendment, because she was denied an abortion when it would likely have saved her life. As was Sheila Hodgers, or Ms Y, who went on hunger strike when it was clear the Republic of Ireland wouldn't allow her to have an abortion, or PP, who was kept on life support after being declared brain-dead on the off chance she could carry the fetus in her to term, or Amy Dunne, who was refused the right to travel to the UK to terminate her anecephalic pregnancy (which would not have lasted outside the womb, anyway.) The whole point of the eight amendment in the first place was to ban abortions in all cases, even when both the mother and the foetus would die as a result. William Binchy*, its author said as much. However because the women's' movement was gaining ground they had to pretend to care for the women so they stuck in the "equal right to life" bit to placate the feminists thinking that no "right thinking" judge or politician would legislate to protect women. Unfortunately for the Opus Dei SS the X case happened. Though it took 21 years after that for the Dáil to legislate and ensure the legal position was constitutional. PS Harry Whelehan is an absolute shit of a man. He was the fellow that allowed Fr Brendan Smyth free to abuse hundred's of boys and girls. *Yes, he's Maeve Binchy's brother. There's a saying over here, which didn't originate here, "if men could give birth there'd be no 'pro life' movement". And it's true.
