Her inaction is what is being discussed. She didn't act to protect her children in a reasonable way. That's it.
It is still a crime, but not one of murder or manslaughter - to be guilty of murder or manslaughter your actions have to have at least contributed to somebody's death. Her actions didn't contribute to the death of her kids - if they had she would have either been convicted of manslaughter or a murder charge. But this is fucking America, the place where police officers gun down innocent people including children in cold blood, so who knows what other horrific ungodly fate awaited the kids had they survived.
That's not to say I think she should have custody of her children mind you. She's neglectful and possibly abusive.
