None of these are sexual until you get into the seamen part of this thread's subject. THAT is sexual. So I don't really get why you brought up other acts and tried to compare it to what happened. We get it, you aren't American whoop-de-do, if this had happened anywhere else it would still need to carry criminal charges.

No, it wouldn't. There have been incidences, so there's precedence. The perps have been fined, as is usual with cases like that. It's considered a misdemeanor for a reason, but there are consequences. A few of them I have mentioned above. Such as suspension, if it happened in a school or dishonorable discharge if it happened in the army. Which it did, more than once.

Most things carrying extended sentences in the US end with a fine in Europe. Such as fucking in the streets or exposing yourself in public or taking a leak for that matter. Some things end with a fine or probation. Such as smoking and possessing without the intent to supply, or with the intent to supply but the quantity being minute.

And for the record, in our case it was injecting urine into fruits served to our teachers.
