Yup. The city where I live, a really young girl (17) ran a red light and two people were killed. She got off because there was no proof one way or the other about texting. Maybe her dad was the mayor, idunno, but she got away with murder, imo. Driving while texting IS considered a crime here in California, but treated as low level, I guess. I got rear-ended many years ago (1997) and bought a gigantor Buick so that the next time I got hit, the dumb shit would suffer more. I haven't been hit since, so I can't report the success of my decision.
I was hit in a 6500lb 1.5 ton pickup at ~60 MPH by a texter in a smallish BMW while turning into a restaurant. The impact cracked two of my ribs and sent me careening into a parked car. No big deal in the great scheme of things. It sure cost her insurance company a lot of money so I personally can't complain.
This thing is a freaking menace though. What difference does it make if a driver hits you while drunk or completely inattentive because of texting? The result is exactly the same and the consequences should be the same. An unguided car at high velocity is a lethal menace. What difference does it make if someone creates that situation because of texting or because they are drunk? It's the same criminal negligence IMO.
Only two things are infinite, the universe and human stupidity, and I'm not sure about the former.
