My point was that, in countries where incest is a punishable offense (most of them, I think), the laws  make no distinction whether the incest is homosexual or heterosexual.  This kind of makes the 'genetic risk' argument moot.  If it applied, then the punishments for heterosexual incest should be more severe.

Well, no, it doesn't make it "moot," as the vast majority of people are heterosexual. It simply means that the genetic risk doesn't factor in if the "offenders" are purely homosexual.

Of course it makes it moot.  If a justification for criminalizing incest is the increased risk of birth abnormalities, then homosexual incest should be considered less of a crime than heterosexual incest.  It isn't.
