Early single action revolvers must have the hammer pulled back to fire. Furthermore - it is highly unlikely to fire if pulled to less than half cocked and released- as the spring is not under enough tension to cause the firing pin to hit the primer hard enough for ignition - that is the PURPOSE of the half cock. And if fully cocked only pulling the trigger will release the hammer.

Modern single actions have a transfer bar - and will fire ONLY if the trigger is pulled with the hammer cocked. 


FAR MORE LIKELY - is his memory of the event have adapted to relieve himself of the guilt as result of his stupidity. Or he is lying.

Yeah, that seems more than a little sketchy. Sounds like something he said on the advise of counsel (if so, he needs better lawyers).

It might well serve as his defense - if his lawyer can pack the jury with uneducated folks who can be made to believe " the gun just.went off".
