Not in America. Here, it's a civil tort and adjudged differently. First, it's not "beyond a reasonable doubt", but rather "a preponderance of the evidence" in court. Second, there is no incarceration involved. And third, there is no stain on one's criminal record.
I cannot speak to New Zealand law, but in America, this is solely a civil tort.
