The whole point is to do away with those who would hurt and kill others - not pay for them to go to prison to get a free education in the pursuit of criminal activities.
You also do not have a legitimate point by asking me "How could that go wrong?" when the system we currently have has gone COMPLETELY wrong.
Saying its not legitimate does not make it so.

If they can't get the incarceration system right, how the HELL can you trust them with human life.
Proclaimers of the virtues of the death penalty seem to couple it with a utopian incorruptible system to ensure only the "obviously" guilty are killed.
Experience should tell you, that is not only highly unlikely, but almost certain not to be the case.
