Wait, was she swerving out the way because she was going to hit it? Or generally just trying to get round it by going onto the pavement?

If the former then the ruling is pretty harsh surely, if the latter, it's a pretty childish ruling which as chuck says could actually cause more bloody accidents. Also why the fuck am I reminded of judge judy with this story...
