I can't view the video from work, but I read the story elsewhere. The crosses have been up for at least two years. Plain markers would have done the same job without making it a church/state issue; and if it had been an explicitly non-Christian or non-Jewish symbol, like a Wiccan star; it would have been off the property a long time ago. It isn't persecution to not make exceptions to the law because you're a Christian and very sad. No one wants to intrude on a mother's grief, but it isn't a license to break the law as long as you want.
