I have compassion for people who are raised in bad environments, but everyone is exposed to some sort of positive environment. Yes, it sucks that people are raised seeing this kind of thing as okay. I see it the same as child abuse. You can lean on your past and use it as an excuse up to a certain point, but the moment you harm a child you are no longer a victim. Even with someone with mental health problems, maybe they can't be blamed if their condition is so severe that they don't realize what they're doing, but victims? I just cannot see it that way.
If they have a serious enough mental problem they won't go to jail, mental facilities are the way to go, but only if the condition completely stops freedom of decision and to evaluate the legality of conducts.
Let's say a kleptomaniac, he can't be guilty of patrimonial crimes, so he/she'll be sent to a mental appointment to surpass the problem. If a kleptomaniac murders someone, then he can already be guilty
Not true unfortunately. My sister works in a jail and almost every single one of them has a mental illness. She was intaking a patient one day and it turned out to be a guy we went to school with that she had worked with. He even remembered her name, aw.
He was a rapist that shoved objects up his penis to Punish' himself. Mentally incompetent get thrown in jail. Here in America, anyways. And she worked in the sexual criminal mental health detention unit one time.. Those guys had to be literally unspeakably sick fucks, to get put in there as opposed to jail. I mean SICK. I hate to say it, but mental health (sickness) is the main reason our jails are full. And I honestly do empathise with every single one of them.
If I were to create self aware beings knowing fully what they would do in their lifetimes, I sure wouldn't create a HELL for the majority of them to live in infinitely! That's not Love, that's sadistic. Therefore a truly loving god does not exist!

I say again: No exceptions. Punishment should be equal to the crime, not in excess of it. As soon as the punishment is greater than the crime, the punisher is in the wrong.
