One is often accused of murder whether murder they committed or not. There is such a thing as to be 'acquitted' of murder, after all.
Unless this person has been found guilty of murder (which does not necessarily mean that they actually were guilty of murder): whether they are a murderer or not is a matter of conjecture and debate.
Perhaps they have a 'stand your ground' law Have it or don't have it: Iran's legal system actually doesn't interest me.
