Initially yes he has his hands in the air, he then for some reason runs away. In that situation you do one or the other, not both. And when he stops and turns his hands are definitely not in the air.
So, I watched it again, and yes his hands are not in the air, but they arestretched out forward where it's impossible to say that he was reaching for something. It's almost as if he's stretching his hands out to show them he doesn't have anything.
Regardless, I don't think there's going to be any way to legitimately pin this on the victim.
Yeah, I rewatched it again, and yes, he didn't have his hands up after he turned and faced the officers. His hands were away from his body and he wasn't in a threatening posture at all as far as I could see. While there may have existed some legal justification at some point during the encounter - I'm not seeing it *at the time he was shot*.
