Well, they will when they get the chance. All she's done is file it; once she does that, it becomes public record, and then gets all over the news, and whatnot. Basically, she'll get one chance to tell the court why this lawsuit should go forward (that is, why it shouldn't be dismissed for a number of reasons). It will be literally impossible for her to meet her burden, and the suit will be dismissed at the end of the argument, but she gets that one chance.
Also, she apparently cites "Jenesis" for her position.
