Unless your clients father in law passed a very strict background,has a stamp, and payed the tax......his possession of that machine gun is already illegal. So was it;s sale, either in whole or in pieces..to him.
The other possibility, is that your clients father in law didn't actually purchase a machine gun, in part or in whole.
According to our common sense gun law, you can't purchase a gun without a background check unless it's a peer to peer sale. Gun shows don't qualify for that loophole. Retail stores like walmart don't qualify, Gun manufacturers don't qualify.
According to our common sense gun laws, crazy can't buy a gun.
According to our common sense gun laws, guns and their ammo must be safely stored.
Breaching any of the above (as purchaser or seller) is a felony.. States also have additional crimes and regulations. So do counties. Cities, particular neighborhoods...and specific buildings - yet more gun laws. It's not that we don't have good, common sense gun laws...we have a mountain of them. People don't follow them. Institutionally, we lack both the will and the funding to uniformly enforce them. It's a vicious cycle, our unwillingness or inability emboldens and normalizes the actions of those who break those laws to begin with. The ATF isn't going to catch them. It doesn't -wan't- to poke every hornets nest, and couldn't afford to if it wanted to. That leaves the onus on the locals..who -sometimes- use confiscations as a way to generate revenue...but they're similarly limited.
