It’s a combination of the law and societal norms that decide what you have the "right" to do. If I can do something openly, and suffer no comeback, then I have been granted that right, in that area. If I suffer legal consequences or I get bad treatment from people/society, then I don’t have that right.
Whether or not I should have the right to whip someone to pieces because it says so in my favourite book, is a different matter. So is whether I should have the right to hold hands with my boyfriend without being hit with a piece of pipe, because I see that as an unreasonable reaction to a non-threatening situation. Reality trumps books.
