maybe no one will understand
but just imagine being born to a poor family in india - struggling all your life, then getting a chance to come to america to a university, parents are so proud and filled with hope.

then imagine how the parents are feeling when their sons sentenced to prison for 5-10 years because he made a online video of his roomate who has sex who has sex in their room.

i sympathize with homosexuals, but i am also against punishment

i believe in rehabilitation over retribution. and why send this guy to jail and then deport him back to india? whats the point? why not just deport him now.

being in jail myself for a stupid reason this fires me up even more.

what can i do to help him? my insides are burning with rage. can i start a petition online? contact the ACLU? OBAMA? WHAT CAN I DO

it pisses me off to live in such a fucked up world - i hate god he fucks everything in this life - and when i see shit like this i just want to fucking slice my throat - i dont want to live in this shit world

He did deserve some sort of punishment. HOWEVER, I do hate when people use Orwellian thought police language like "hate crime".

Jealousy is also an emotion but we don't have "jealousy crime" laws. Is someone less dead if their spouse murders them out of "hate"?

His crime was invasion of privacy. I do warn minorities OF ALL LABELS that language in law can backfire long term for ALL of society when it attempts to set up taboos.

When you make attempts via government to censor speech, that is a short term band aid. Long term EVERYONE in the majority and minority should remember that power shifts over time and the people who are the judges and juries and lawyers and law makers may not always agree with what you want to say. The worst any person can do if they want to maintain their ability to bitch, is to hand a loaded gun via law to a government that can use it to silence them.

Now, regarding this guy. Again, his crime was not having the emotional reaction to something he didn't like, his crime was the actions he took.

While his homophobia motivated him, merely being a ignorant bigot cannot be a crime. Otherwise it would be very easy for that slur to be aimed at atheists and this website through "hate crime" utopia idealism could give license to lawmakers to shut down this site.

ACTIONS and violence and calls to violence can be the only factors. No one however on any side or sect or political party should ever have the power to create a situation where they can use government force to be free from merely being offended.

If I arrested everyone who equated atheists to Hitler or threatened me with hell, there would be tons of people in prison. Instead of insisting they don't offend me, I tell them that the "offense" is not the fact that you said it, the offense is that you have no evidence to justify your stupidity.

Are we talking about the story where a thoughtless jerk recorded his roommate having sex and then published it on the internet? And then the distraught and humiliated roommate committed suicide?

If we are discussing that story, my understanding is that the person in question spied on his unsuspecting roommate with a hidden camera, then recorded his unsuspecting roommate having sex on video and finally published that video on the internet without the consent of the roommate. These alleged reckless violations of his roommate's privacy and public humiliation led to a suicide. Do I understand this story correctly and is this the story we're discussing?

If my understanding is correct, why should he not be sent to jail?

The guy was convicted of both "invasion of privacy" and "hate crime" because he filmed without permission the guy having sex with another guy, and then one guy committed suicide because his room mate outed him to embarrass him.

I think while it was right to convict him of invasion of privacy because he didn't ask for permission to film them, I think the other criminals were society who feed him the bullshit in the first place that he should hide it.

If I had been the friend of the guy who killed himself, I would have told him to fight back and sue the fuck out of the guy and that being gay was nothing to be a shamed of. Society is who killed him. If he had been given the dignity of self, he wouldn't have killed himself.

I would agree that gayness is beside the point. If he'd recorded and published his roommate having sex with a woman or just masturbating by himself, and did all this without any consent or permission by the roommate, it would be an invasion of privacy and public humiliation. A jail sentence is called for under such a situation.

You're full of shit. Ravi was born to a well to do family. His parents had bought him a car (BMW) when he graduated.

He may not have been homophobic, however, he did invade his roommates privacy. He did harass him. In his own facebook transcripts, he has plotted to expose his roommates private life to ridicule.

How was he supposed to know it would cause him to commit suicide? He didn't, but it was wrong and he did the act anyways.

That contributed to the death of a student.

You can understand why Rutgers is not pleased, and why the courts are intent on making an example -- the other option is to send a message that wiretapping those you dislike and harassing them is permitted. It is not.
