Texas Will Execute A Mentally Retarded Man Today Unless The Supreme Court Intervenes | At 6pm CT (7pm ET) today, the state of Texas is scheduled to execute Marvin Wilson, who was diagnosed as mentally retarded by a court-appointed psychologist. Executing the mentally retarded is unconstutional, yet Texas hopes to exploit a loophole in the Supreme Court opinion declaring such executions to be unlawful in order to execute Wilson anyway. Unless the Supreme Court intervenes before the execution takes place, Wilson will die despite what the Constitution has to say about it.

It is certainly true that Utah (and Texas) are part of the US, but you also need to recognize that we're a huge culturally diverse country, and what the US looks like depends largely upon where you happen to be standing at the time.

That was not a no true Scotsman. At what point did I say no American would do that? Did I at any point suggest that the judge was not a "true" American? Firstly, it was widely meant as a joke, though clearly meant as a dig at Utah's standards. Furthermore, you can equate Utah and Texas to America all you want, but you are seriously kidding yourself if you think the backward south and midwest are anything like the rest of the United States. Also, it is literally not "America."

On a side note, I find it funny that people take themselves so seriously that they think they can understand the entirety of this nation based on what one judge does in one state without bothering to remember that state laws govern such shit. If you read the article, you would see that the law allowed the judge to behave as he did. He behaved in a way that a judge could not in my state. In short, think in scope, not in platitudes, if you please. That is not directed specifically at you, pad. There just seems to be this ridiculous notion that a nation more than 3,000 miles wide and containing a total of 50 state governments is all the same.

I would never disagree with that, hence my statement that it is not "America," but Utah. Were it a universal law that you could abuse children for relatively small indiscretions in the United States, federal law, in other words, I never would have said that. If you can separate states into two types, if one thing is only typical of one type, you cannot say it is "America," so much as whatever it is that differentiates it from the other states. There is no execution in my state. There is no child abuse in court rooms. We have good health care. We're not perfect, but this sure isn't Utah, Texas, Kentucky, Tennessee, etc.

I am not discounting the diversity, Shell, but I think the narrowminded vindictiveness seen in this case offers insight into a strain of latent,self-righteous sadism, a tendency towards smug graceless self-satistaction coupled with schadenfreude, that is more influential in the aggregate behavior of this country than we are willing to admit.
