Hm. You know, ten years ago I used to be a major gay-basher. I used to be a lot of things, in fact, that I am glad I am not now. Today, I read that DOMA died. And then, I smiled.

You know, it's strange, it's almost like we Americans have...dare I say it...found our sanity as a nation? Is sensibility progressing? By the goodness and the Constitution it seems we have and it is!

After the U.S. Supreme Court repealed the Defense of Marriage Act earlier today, Michele Bachmann released a statement reiterating the same ol' anti-gay marriage talking points.

"Marriage was created by the hand of God. No man, not even a Supreme Court, can undo what a holy God has instituted," Bachmann, who isn't seeking another term in Congress and narrowly won reelection last year, wrote.

A short time later, House Minority Leader Nancy Pelosi, D-California, was asked what she thought about Bachmann's statement.

"Who cares?" she replied.

Yes WE do! I have friends who have lived together as a straight couple for more than 30 years. She just walked in and when I asked if she had heard the news she said "Yes, even Richard and I are thinking of getting married now."

In a country that claims to be the bastion of freedom, it is refreshing to see that the highest court in the land is willing to acknowledge an estimated 10% of the population. Everyone deserves freedom. Not just 90% of the population, everyone.

But just a note: the court's decision in the Prop 8 case was to dismiss it on procedural grounds. It's a slight victory for gay marriage, but not a major one then because the court essentially sidestepped the argument of whether or not marriage was a Constitutionally given right. Meanwhile, its decision in the DOMA case is actually a major win as it gives same-sex couples the same benefits as heterosexual couples.

The battle is won, but the war is not over!

Yes, but the court decision striking down Prop 8 is unlikely to be challenged again, and we now have one more state where gay marriage is legal. Slowly but surely the country is allowing marital freedom and homophobes are running scared.

As a Californian who (obviously) voted against Prop 8, I find, indeed, it is a small victory, but an immensely satisfying one. So I will say:

I don't want to piss on the parade here but some of you are jumping the gun. What these two rulings do, collectively, is to reinforce state's rights. If a state wants to allow gay marriage, it can and if it wants to deny gay marriage, it can. The federal government cannot discriminate against citizens who are legally married in a given state. Moreover, in the Prop 8 situation it denied the right of a citizen to challenge a ruling on a technicality. This worked great in California where the governor decided not to challenge the lower court ruling but let's take any state in Jesusland for a counter example. If only the state government can decide to bring an appeals ruling forward what the court has done is sanctify TWO Americas.

Add in the disastrous ruling on the Voting Rights Act of just a day ago and we see a growing divide between the liberal coasts and the fascist south/west being codified by state law.

So temper the enthusiasm with a dose of reality. There is a long way to go in this country.
