Now, It isn't clear that he bought it new (and for the price quoted in the report it seems like it may have been used, but you never know, sales and all)...so it may be that a previous owner had damaged the weapon, that the reseller had sold a defective weapon (on and on). None of this, of course, excuses the man from scratching his head with a loaded revolver.

(the pistol in question is a Windicator, btw, not the best, but compliant with standards)

-and that it's unlikely that it "just happened" or "just went off". The "just" ignores absolutely everything that could or did lead to this event (or any nd).

The owner was clearly unaware of many things. Again, he was scratching his head with a loaded revolver. Just because he didn't know it was broken (or whether or not he broke it) doesn't mean that negligence wasn't the cause of the discharge, rather than "guns just go off" - can't stress this enough...they really don't (I've opined about this in other threads...there are a disturbingly large number of these claims that just don't get the owner of the firearm the proper "attention" because we are incredibly lax regarding gun law enforcement. That laxity has very clearly bred a "gun culture" entirely alien to the gun culture that I grew up in. It's fucking it up for me and mine.......)

Witnesses have him scratching his head with the revolver. Whether he knew it was loaded or not was disputed. But as I recall from the hunter's safety class I took when I was 12, you're to treat every gun as if it's loaded.

Not a problem if you follow the rules of gun safety. If you never point a gun at a person, you're unlikely to hurt a person with it.

... after being handled irresponsibly by a person who had been drinking.

If a weapon isn't cleaned, it can and will malfunction. If your brakes are poorly maintained and that causes an auto accident after you had been out drinking, does that mean that the auto is poorly designed?

As pointed out above, the first rule of gun safety is: Every gun is loaded.
