I have no problem with the opinion's interpretation of constitutionality in this matter. What I don't know enough to understand is the basis for rendering the opinion. I understand the argument that this court's decision will have direct impact on the execution of the Executive Order (EO) in the downstream deportation civil case, but I don't know if this is sufficient cause to render an opinion on the EO's constitutionality. Seems reasonable, but again that's for a higher court to decide.
I have to assume that most people already have opinions regarding the immigration issue, including the reality of current immigration relative to the current law. What bothers me the most is how people, having already chosen sides, react to how the system works. In large part everybody is content with superficial reactions rather than having any meaningful dialogue regarding the merits of the law being considered. Liberals will squeal 'activist judges'; conservatives will exclaim 'suck it Mr. President'. Change the topic and the reflexive reactions would be reversed. All the while people are content with continuing to bitch about problems instead of working to fix them. Our current immigration law is FUBAR, and has been known to be so by everyone for a very long time. Congress, whose job it is to enact and change law, is to blame for the current morass; both parties. The last time we were close to resolving the issue the GOP fucked us. Shortly after the Democrats gained control of both houses and couldn't fucking be bothered. Just an assumption, but I think nothing gets done because many politicians fear removing an easy way to get their base riled up before the next election. GOP - we'll kick all the 'others' out; DEM - we'll make sure we don't remove your parents/grandparents: "vote for me"! Fuck 'em all. The charge that Obama and his advisers on immigration don't understand the Constitution is ludicrous. Do those of you rolling out this bit of insipid bullshit really believe this? There is no doubt in my mind that a small army of lawyers poured over the law in an effort to create a workable EO that could be defended. Whether that defense would be adequate or not would ultimately be up to the judicial branch. Despite the fact that I agree with the opinion in this case, I applaud the executive branch's attempt to overcome an inept Congress and provide a temporary solution to a problem that everyone recognizes. What the GOP doesn't fucking get is that all declaring this EO unconstitutional will do is push down prosecutorial discretion back to where it existed before the EO; at the individual level. Congratulations champions of government waste, you just ensured that we'll continue to spend a shit load more money to reach the same result. This decision should be used as more ammunition to get Congress to fix the problem. Instead, I predict the electorate will continue to be satisfied with slinging shit and living with the current situation. RE: Judge declares some of Obama's action on immigration unconstitutional

Seems reasonable, but again that's for a higher court to decide. I am old enough to know there is a psychology to humans when it comes to power, the in party is happy and the out party is paranoid. The biggest reason I am against the GOP and libertarians isn't that their politicians use the same tool, the biggest issue is the long term damage and to much power to big money. Liberal voters suck at midterms and our politicians are pussies. The funny part is that Teddy Roosevelt was a Republican who would have to run on an Independent or liberal ticket today. If anything has fucked up our immigration it has been our low wage mentality business owners jerk off over. It is far better to spend the money to put everyone who comes here under the same pay and documentation as those who live here, no matter how they got here. Outside that it is case by case and both sides can agree that anyone arrested or convicted of a violent crime should be deported. I have living next to me on both sides of my house, two Hispanic families. I do not know their status, but I do know between the three of us I am the worst neighbor. I don't mow my lawn until the grass gets taller than my roof, and I shout at my computer loud enough for them to hear. They have been quiet and have been great neighbors. I look at anyone coming here as a human first. The waste of money I see is treating even legal citizens like criminals by default rather than the top paying everyone enough to survive. |
