Not at all, but if it were, then it's a done deal - as already mentioned. If a person claims that someones been murdered, for example, but there is no body, and no missing person........the evidence suggests(lol) that said person is lying or mistaken. If there is a body, or a missing person...and nothing other than eyewitness testimony as to how that person ended up dead or missing....a conviction is going to be exceedingly difficult to secure. The defence need only remind the jury that the prosecution has not established a single detail of the crime or even that a crime occurred, merely pointed a finger. I seriously doubt that a charge would be brought against a person until there was something more than eyewitness testimony in the first place. What kind of incompetent prosecutor steps into the courtroom with nothing but "he said, she said"?

Sure, but I mean, that is where this is all headed, IMO. I don't think RR is really interested in court cases, or anything like that. This is going to end up being about personal experiences of a supernatural nature, backed by nothing.
Eventually.
He is of course welcome to tell me what the actual point of this is, if there is one. Everyone has already conceded that testimony can be correct.
I'm going to stop speculating at this point, in fact I'm just going to give up the ghost.

I'd be pleasantly surprised if I'm just being too cynical, and this did actually have a point other than creeping towards validating outrageous claims. Seriously. I love a good discussion. But there doesn't seem have been any progress since the first couple of pages.

I think it is reasonable, that given contrary evidence; that the stronger of the two should be followed. Don't you? In the case that you gave, the witness testimony wasn't that strong. In other instances, the forensic evidence may not be that strong. I'm not making a black and white rule, that you must always follow, regardless of the details. I think I am consistent here, and my position has been all along, that physical evidence does not necessarily rule out testimonial evidence or that only physical evident is permissible (which is what I'm opposing). When dealing with contrary evidence, then there necessarily has to be a mistake or fabrication somewhere.

You need evidence to determine the strength of eyewitness testimony? What happened to the reliability of eyewitness testimony, sounds more like the reliability of evidence to me.

Sounds like the argument from ignorance, too. If you can't prove the witness testimony wrong, and it's not obviously flawed, then it must be right (or at least should be properly considered).
All it actually gives you is a possible starting point to investigate.

Of course, if the claim is mundane and not especially importantly, I'll happily accept witness testimony from someone reliable.
