It's a damned if you do, damned if you don't situation. Say Joe does something terrible. To prosecute him, you'll need to remove him from the aoe and trib him. The effect is that a bad guys gets spirited away in the locals perception. Say Joe does something terrible and you leave him in theater (for on-site trib or just because). From the locals perspective you've just backed up...for example... a rapist.
As to whether or not invasions of, say...Iraq, could be prevented if any given soldier refused. That's ridiculous. Someone would always say yes. I've asked this question alot. I'll ask it here. Who would you prefer be the triggerman for our military? A guy like me, or some sub they had to entice because I refused? Go to war or go to jail, baby.
