I'm not sure how it works in the gov, but even if one is fired for cause in the private sector, vested pensions are untouchable and will be awarded to the retiree. If he violated a law and is going to be tried, that's an issue. But I'll bet this is purely symbolic. Let's wait and see if he goes to trial. I have a bunch of nickels to anyone's doughnut holes about how it will end up.

McCabe could also waive privacy rights and demand that the reports from the IG and from the FBI' s Office of Professional Responsibility be released. That way the public can see what was in those reports and determine whether or not there was clear basis for his firing, according to Alan Dershowitz.
