 When do you cross the line into "mercenary?"
When your primary allegiance is to your pay over your oath. When you could be bought, in that moment, by the enemy.
I am the Infantry. I am my country’s strength in war, her deterrent in peace. I am the heart of the fight… wherever, whenever. I carry America’s faith and honor against her enemies. A professional army of volunteers is the middle point between militia and mercenaries. It's meant to combine the strength of both, and to leverage each strength against the weakness of the other.

The Roman Army was an all-volunteer force by then. Really it had been for over a century, since Marius.
Clearly not in that instance.
