From the first paragraph:

Quote:This is a US federal law.

Sixth bullet point in the article:

Quote:The flag should never be used as wearing apparel, bedding or drapery.

In other words, flag swimsuits are technically illegal, but it doesn’t really matter.

Boru

Read the first SENTANCE of your link. It is an ADVISORY. NOT criminal or civil law.

Big difference.

Big difference.

If it’s not a criminal law, why does the code provide penalties for breaking it?

You are wrong and should keep reading. that first paragraph states that it is federal law and here is the law:

See any penalties assigned?

No?

Because it is not criminal or civil law.

The US Supreme Court ruled many years ago (1989) that desecration of the US flag is protected under the 1st Amendment. Burning, in that particular case.

Pff. Freedom of speech until what they don't want to hear comes up. And the chump has been trampling on the Constitution for years, now. His worshipers are eating that up, too. It'll be a good day when they have to slink back down. I think that burning the flag is an extremely misguided act, though. It just makes the people doing it look like rabble, in my eyes. Then again, driving around with flags on the trucks like has been mentioned, I consider just a different kind of rabble. Freedom to look like a jerk is a right.

Because it is not criminal or civil law.

18 US Code Section 700 - Desecration of the flag of the United States; penalties

Quote:(a)
(1)
Whoever knowingly mutilates, defaces, physically defiles, burns, maintains on the floor or ground, or tramples upon any flag of the United States shall be fined under this title or imprisoned for not more than one year, or both.
(2)
This subsection does not prohibit any conduct consisting of the disposal of a flag when it has become worn or soiled.

It is a law that you can't use your flag as an article of clothing. If you do, you can be punished for doing so.

To repeat, just because the law is never enforced and breaking it is never punished doesn't mean it isn't a law.
